Dresden Court of Appeals Upholds Decision against Netlantic and shift TV
Munich, January 16, 2007. The Dresden Oberlandesgericht (Court of Appeal)
upheld the Leipzig District Courts May 12, 2006 decision of first instance
against Netlantic GmbH and its shift TV service. Netlantic GmbHs appeal
was dismissed. According to the judgment of the Oberlandesgericht, shift TV
is prohibited from storing programs in order to transmit them to third parties. In
its decision, which is not yet final, the Dresden Oberlandesgericht sustained
the finding of the Leipzig District Court that there had been a violation of
copyright and unauthorized copying. Netlantic GmbH has appealed the
decision to the Federal Court of Justice.
For the ProSiebenSat.1-Group the judgment of the Dresden Oberlandesgericht
confirms the companys position that its program signals can not be used by
service providers without prior consent of ProSiebenSat.1 Media AG.
